Someone has already posted a comment there stating it is NOT in the public domain....which it isn't! MGM/Warner Bros. has a copyright on it, and it should be REMOVED from IA!

This film has long been considered PD.

-The films title card reads "COPYRIGHT SECURED IN USA BY METRO-GOLDWYN-MAYER. ALL RIGHTS IN THIS MOTION PICTURE RESERVED UNDER INTERNATIONAL CONVETIONS. PASSED BY THE NATIONAL BOARD OF REVIEW. CONTROLLED BY LOEW'S INCORPORATED" This is an incorrect (invalid?) copyright notice.

-I have the Turner Entertainment/Warner Bros DVD of Freaks. It mentions no renewal date. It simply says "Freaks (c)1932." It doesn't list a copyright owning entity. Turner has put a number of PD films on DVD, especialy as bonus features on DVDs. Gaslight, Dr Jekyll and Mr Hyde, The silent Wizard of Oz films are good examples. They generally act as if releasing any PD film in their library restores the copyright.

-One of the oldest PD video distributors "Hollywood House Video" had this film in their catalogue in 1980 (Cat no-113)

But how come that no other PD distributors have this film in their catalogue ?

PROBABLY because it's NOT really in public domain....otherwise, a whole lotta people would have jumped on this film.

Actually, I read that Dwain Esper bought FREAKS from MGM, to show on his roadshow. It is common knowledge that later, in the 60's when REEFER MADNESS was revived and being showed without Esper's consent that he tried to stop it being shown, but couldn't do anything because he had failed to renew his copyrights. If he didn't renew the copyright on REEFER MADNESS, it would be safe to assume that he didn't renew the copyright on FREAKS either (often showed as NATURE's MISTAKES.

The problem is that he (Anton LaVey) never owned the rights on this film :)
the only persons who ever owned rights besides of MGM/UA was Mrs. Werby and Mr. Raymond Rohauer until the copyright reverted back to MGM/UA.
